1. Acceptance of terms

By creating a Postavya account or using any part of the service, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the service.

2. Service description

Postavya is a multi-tenant marketing automation SaaS. It provides AI-assisted content generation, brand memory, campaigns, reusable funnels, scheduling and publishing to social platforms you authorize. We connect to third-party platforms only after you explicitly authorize each connection.

Postavya owns one production OAuth application per social provider. You authorize your own accounts through that application. Your tokens are stored server-side, isolated by workspace, and never exposed to clients.

When you connect or use YouTube through Postavya, you also agree to the YouTube Terms of Service. Postavya uses the connection only to show channels you manage and upload videos you explicitly approve, as described on our homepage and in our Privacy Policy.

3. Eligibility

You must be at least 16 years old and able to form a legally binding contract to use Postavya. You are responsible for ensuring your use of Postavya complies with all laws and with the terms of service of every social platform you publish to.

4. Accounts and workspaces

Every user receives an isolated personal workspace on first use. You are responsible for maintaining the confidentiality of your login credentials and for all activity in your workspace.

Future team workspaces use owner, admin, member and reviewer roles with least-privilege permissions. You are responsible for activity by anyone you invite into a workspace you own.

5. User responsibilities

You agree to:

Provide accurate account and project information.

Maintain the confidentiality of your login credentials and BYOK AI keys.

Review all AI-generated content before approving and publishing it.

Comply with each social platform’s terms of service when publishing.

Not use Postavya for spam, illegal activity, misleading content, or content that violates platform policies or third-party rights.

Not attempt to access another customer’s workspace, tokens, keys or data.

6. AI-generated content

AI-generated suggestions are drafts that require your explicit approval and explicit destination selection before publishing. You are solely responsible for the content you choose to publish.

Postavya makes no guarantees about the accuracy, appropriateness, originality or performance of AI-generated content. Generation provider behavior, model outputs and provider availability are outside Postavya’s control.

7. BYOK and managed AI modes

On the BYOK plan you supply your own AI provider credential. You are solely responsible for that credential, its cost, its permitted use, and any rate limits or terms imposed by your AI provider. A ChatGPT subscription does not supply or pay for OpenAI API access.

On the Managed AI plan Postavya supplies Google AI quota through its secure backend. Quota allowances, overages and entitlements are configured and enforced server-side. The client is never trusted to declare its plan, remaining credits or permission to generate.

8. Subscriptions, usage and billing

Published plans are the $5/month BYOK plan and the $20/month Managed AI plan. Subscription entitlements and overages, when billing is live, are enforced server-side using a usage ledger. A completed text generation request counts once even when it returns platform variants; each delivered image counts once; video tracks both completed jobs and generated seconds where provider charging depends on duration.

Failed-before-provider jobs consume no quota. BYOK customers are not charged the AI provider cost again by Postavya. Any future Postavya infrastructure overage is separately named, priced and disclosed.

9. Publishing and scheduling

Scheduled times are content-planning targets only. Postavya does not publish a post merely because its scheduled time arrives; you must review it and explicitly choose the publishing action.

User-initiated publishing uses deterministic idempotency keys and leases to avoid duplicate posts. Postavya is not liable for provider-side behavior, including failures caused by expired tokens, revoked permissions, or platform restrictions.

10. Intellectual property

You retain ownership of your brand data, project memory and content you generate or approve. Postavya retains all rights to the service, including software, designs, prompts, server prompt templates and brand assets.

You grant Postavya and its infrastructure providers a limited license to process your data solely to operate the service for you, in accordance with this agreement and our Privacy Policy.

11. Prohibited uses

You may not use Postavya to: send unsolicited messages or spam; impersonate others; publish content that infringes intellectual property or privacy rights; harass, defame or harm others; circumvent platform rate limits or terms; or attempt to disrupt, reverse engineer or overload the service.

12. Service availability

Postavya is provided on a commercially reasonable basis. We do not guarantee uninterrupted or error-free service. Maintenance, updates, provider outages and platform-side changes may temporarily affect availability. We may modify or discontinue features with reasonable notice.

Unapproved suggested or discarded drafts are deleted after 30 days. Stored post images and videos are deleted after 365 days, including media attached to retained posts. You are responsible for downloading media you need to preserve beyond these periods.

13. Limitation of liability

Postavya is provided “as is” and “as available.” To the maximum extent permitted by law, Postavya is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, audience or reputation, arising out of or related to your use of the service, including content that violates platform terms, provider failures, data loss or service interruptions.

14. Indemnification

You agree to indemnify and hold Postavya harmless from claims, damages and expenses arising from your content, your use of the service, your violation of these terms, or your violation of any third-party rights or platform terms.

15. Termination

You can stop using Postavya and delete your account at any time. We may suspend or terminate access if you violate these terms, create risk or legal exposure for Postavya, or fail to pay amounts owed when billing is live. On termination, your right to use the service ends and your data is removed in accordance with our Privacy Policy.

16. Changes to terms

We may update these terms at any time. We will update the "Last updated" date above when we do. Continued use after changes constitutes acceptance of the new terms.
